Military service, public office, and Polish citizenship: why the records matter

Understand why military duty, foreign service, public office, and Polish permission require separate evidence and specialist review.

Can military service or public office change the citizenship chain?

Short answer: yes, but no consumer shortcut can decide it.

Old Polish law treated foreign citizenship acquisition, foreign military service, foreign public office, and Polish permission as connected but separate questions.

Every case needs the exact dates, records, and law.

What did the 1920 statute say?

Article 11 of the 1920 Citizenship Act contained separate loss branches for:

Does the military proviso prove that citizenship survived?

No.

You first need to establish whether the person was obligated to active Polish military service on the foreign-citizenship date.

That can depend on:

Even if the proviso affected the foreign-citizenship branch, later foreign military service or another event could create a separate loss question.

What if foreign military service was compulsory?

Compulsion may matter, but the label alone is not enough.

Collect evidence showing:

A specialist must compare the full record with the law in force on each event date.

What counts as foreign public office?

There is no safe list for every country and time.

An employment title alone may not show whether the role was a public office under Polish law. Obtain:

Why is Polish permission important?

Permission can have several meanings in historical files.

Record the issuing authority, legal basis, named people, effective date, conditions, and delivery. A family story that “Poland approved it” is not enough.

What about group resolutions or collective acts?

They require individual proof.

A resolution concerning a class of emigrants does not automatically prove that one person applied, met every condition, received an effective permission, or lost citizenship.

Obtain the individual application and file where possible. Check identity, scope, conditions, delivery, publication, and family effect.

Missing files do not automatically prove either loss or preservation.

What evidence should you collect first?

Build three small files.

Polish military position

Collect registration, call-up, classification, exemption, deferment, release, and permission records.

Foreign service

Collect enlistment or appointment papers, service history, status, oath, duties, discharge, and proof of coercion where relevant.

Citizenship and permission

Collect the foreign-citizenship file, Polish permission or deprivation file, and the next child's birth record.

Then sort every document by legal effective date.
