How do parentage, adoption, and children affect the case?

Short answer: citizenship depends on legally recognized family relationships, not only genetics or household ties.

Adoption and included-child rules are separate from a simple descent assumption. Unusual family facts need individual review.

Legal parentage is the parent-child relationship recognized by the relevant law and civil-status system.

For an Article 5 claim, ask whether the Romanian citizen was the child's legal parent when the child was born. For Articles 10 and 11, every legal link from the former citizen to the applicant must be proved.

Useful evidence can include birth records, acknowledgments, filiation judgments, civil annotations, adoption orders, and name-change records.

Late acknowledgment, a judgment entered years after birth, disputed paternity, or conflicting records may change the timing analysis. Do not assume the effect is retroactive without applying the relevant Romanian law.

Is DNA proof enough?

No.

DNA may help establish a biological fact. It does not by itself decide legal parentage, recognition, effective date, or citizenship consequences.

This distinction matters for nonmarital births, donor conception, reciprocal IVF, surrogacy, posthumous conception, and records naming different parents.

How does adoption work?

Article 6 of Law 21/1991 provides a distinct citizenship route for a qualifying foreign or stateless minor adopted by Romanian citizen parent or parents.

Do not treat this as ordinary descent or restoration. The child's age, the adopter's citizenship, the legal effect and recognition of the order, required consent, and any annulment or nullity issue need current pinpoint review.

A foreign adoption order may require Romanian recognition and civil-status work before it can support a citizenship step.

What about children included with an Article 10 or 11 applicant?

A child may have an included or connected process under the current law and checklist. Do not assume the parent's application automatically resolves the child.

Check at least:

Does a later parental acquisition change an earlier birth?

Do not assume it does.
