Can you claim Portuguese nationality through a grandparent?
Short answer: possibly.
Portugal has a nationality-of-origin route for a person with a second-degree direct-line ascendant who held original Portuguese nationality and did not lose it. That is the applicant's grandparent.
The current test appears in article 1(1)(d) and article 1(3) of the Nationality Law republished by Organic Law 1/2026.
This is not a surname, passport, or document-only shortcut.
What is the exact family chain?
The chain is:
- applicant
- applicant's legal parent
- that parent's Portuguese parent, the applicant's grandparent
The intermediate parent does not have to become Portuguese first. The parent-child relationships still must be proved with legally effective civil records.

What does “original Portuguese nationality” mean?
The grandparent must have held nationality of origin, rather than nationality acquired prospectively through marriage, adoption declaration, or naturalization.
The grandparent also must not have lost that nationality.
A Portuguese birth certificate is important, but one unannotated certificate may not settle nationality type or non-loss. Check the Portuguese civil register and, where needed, the nationality file.
Historic foreign naturalization, marriage loss, former-territory status, reacquisition, or pre-1981 events require manual review.
Is this nationality from birth?
Yes, the statutory category is nationality of origin.
Article 11 of the republished law gives attribution effects from birth. The applicant must still make the required declaration and prove every condition.
Do not describe the outcome as automatic merely because its legal effect is from birth.
What conditions apply beyond the family chain?
The statute requires the applicant to declare an intention to be Portuguese and possess effective ties to the Portuguese national community.
Article 1(3) of the republished law also imports the conditions in article 6(1)(c) through (h). These address:
- sufficient Portuguese language knowledge
- Portuguese culture, national history, and symbols
- fundamental rights and duties and State organization
- solemn adherence to democratic rule-of-law principles
- the specified serious-criminality condition
- national security and defense
- applicable United Nations or European Union restrictive measures
Rectification 17/2026/1 corrects the criminal proof wording. Do not reduce that issue to “any conviction of three years or more.” Offense category, finality, effective imprisonment, and the exact threshold matter.
Does language prove effective ties?
No.
The live Justice grandchild page still describes language in a way that reflects earlier law. The current enacted statute separately keeps effective ties and adds broader conditions.
Language evidence may be relevant. It does not, by itself, prove the entire route.
Is there a current complete checklist?
No complete post-amendment checklist was verified.
The Justice page remains useful for the three civil records, criminal records, legalization, translation, and filing channels. Modelo 1D remains linked through the IRN forms index.
But the form and Nationality Regulation had not been conformed to the current statutory tests at the source-check date. Proof methods for effective ties, knowledge, civic matters, and other conditions are not safe to invent or automate.
Confirm the live requirements with IRN or a qualified Portuguese professional before filing.
Which records are a sensible starting point?
Start with:
- the applicant's full birth record
- the intermediate parent's full birth record
- the Portuguese grandparent's Portuguese civil record
- evidence addressing original nationality and non-loss
- records bridging names, marriages, and parentage
- identity evidence
- criminal records from the countries required by current official guidance

Which cases always need manual review?
Every grandchild application needs current-law and procedure review. Specialist review is especially important for:
- original versus acquired nationality
- any possible loss
- pre-8-October-1981 family or status events
- former-territory status
- adult-established filiation, adoption, or assisted reproduction
- effective ties and knowledge evidence
- criminal, security, sanctions, or opposition facts
- a prior refusal, evidence request, or deadline
What should you do next?
Obtain the three full civil records and identify the grandparent's Portuguese registry entry. Then investigate whether the grandparent's nationality was original and whether any loss is recorded.
Do not pay for a complete evidence packet until the current unprescribed proof requirements have been checked.
