Slovak citizenship questions
Existing status and the prospective Section 7(8) grant are different. Unknown facts always require evidence or manual review.
Does a Slovak parent make me Slovak?
Possibly from birth if that legal parent was Slovak when you were born. An authority must still prove or determine the status. See the birth and status-proof guide.
Is Section 7(8) automatic citizenship by descent?
No. It is a prospective discretionary grant, not citizenship from birth or an unbroken-transmission process. Citizenship begins only after the grant, oath where required, and receipt of the instrument.
What if I might already be Slovak or was Slovak before?
Resolve status first. A current citizen needs proof. A former citizen is excluded from Section 7(8) and needs a separate route review.
Did every Czechoslovak citizen become Slovak in 1993?
No. Slovak republican citizenship at 31 December 1992, not federal Czechoslovak status alone, is central. See the historical-status guide.
Can I apply through a great-grandparent?
Section 7(8) can reach that degree only if the same great-grandparent was a Czechoslovak citizen and born in present-day Slovakia, the applicant was never Slovak, and all remaining conditions and manual review are met.
Can I use a more remote ancestor?
Not under Section 7(8), which stops at a great-grandparent. Do not foreclose a separate existing-status or historical chain without review.
Must citizenship have passed through every generation?
Not for the Section 7(8) grant. The qualifying ancestor facts do not require an unbroken citizenship chain, but a complete legal parent-child chain is needed to prove the degree.
Does Slovak birth prove Czechoslovak citizenship?
No. Birthplace and legal citizenship are separate facts, and both must be proved for the same qualifying ancestor.
Is a census, surname, family story, or ethnic identity enough?
No. Those can be research leads but do not establish Czechoslovak legal citizenship.
Is approval guaranteed if every ancestor fact is proved?
No. The Act says citizenship may be granted, and remaining conduct, proceeding, public-order, security, and applicable-compliance conditions still matter.
Do I need Slovak residence?
The law effective 15 July 2026 appears to remove a residence permit as an entry condition for the Section 7(8) descendant grant. A separate unchanged rule still says proceedings stop if an applicant's residence permit ceases, and some consular pages continue to describe the former residence-first process. Central implementation guidance reconciling those rules has not been located. Confirm the current procedure in writing with the Ministry or receiving authority before filing. If you hold a Slovak permit, obtain case-specific advice before allowing it to expire or cease.
What if my Slovak permit may expire?
Obtain immediate case-specific advice and written confirmation from the competent authority. Section 8a(6) says proceedings stop if an applicant's residence permit ceases, and central guidance reconciling that rule with Section 7(8) has not been located.
Is there a Slovak language test?
The current Act exempts Section 7(8) from the language and general-knowledge condition. Do not generalize that exemption to another grant route.
Should I follow a consular page requiring residence first?
Not without written current confirmation. Some pages retain the superseded pre-15-July-2026 workflow and cannot resolve the Section 8a(6) conflict. See the residence and filing guide.
Which form is used?
The Act requires a written application, the current statutory Appendix 1 applicant questionnaire, a structured CV, and applicable evidence. There is no special statutory descent form. Obtain the accepted version and package instructions from the receiving authority.
What is the fee?
The statutory descendant category was rechecked at €30 for 27 August 2026. Recheck the filing-day law, local currency, payment method, and any post-specific mechanics.
How long does it take?
The statutory period is up to 24 months after the application reaches the Ministry, subject to exclusions and suspensions. Appointment and forwarding time are outside that clock. This is not an end-to-end promise.
Do foreign records need an apostille and Slovak translation?
Foreign documents generally require treaty-dependent authentication and an officially certified Slovak translation. The issuing country, treaty, document, and receiving authority control, so there is no universal checklist.
Does a birth record prove ancestor citizenship?
Usually it proves birth, place, and parentage. Not citizenship. Seek a citizenship certificate, passport, register/file, or certified archival finding. See the documents guide.
Can children join a parent's application?
A child under 14 may be included with a parent. Ages 14–17 apply separately. Consent, custody, representation, signatures, and each child's route require manual review.
Does adoption count?
Do not assume a foreign adoption automatically establishes Section 7(8) lineage or citizenship. Recognition, legal effect, age, the issuing court, and adopter status require manual review.
Is DNA enough to prove the family link?
No. The route depends on legally established filiation. Birth records, acknowledgments, judgments, adoption decisions, and recognition may be required.
Are maternal and paternal lines treated differently?
Current wording is neutral, but older status laws can have sex-, marriage-, birthplace-, or election-dependent effects. Historical chains need event-date review.
Can a former Slovak use Section 7(8)?
No. Section 7(8) requires that the applicant has never been Slovak. Former citizens need classification under a status or separate former-citizen route.
Can I keep my current nationality?
Slovakia does not make renunciation a Section 7(8) condition, but the other country's law and later Slovak loss and reporting rules need separate review.
Can a Slovak Living Abroad certificate prove citizenship?
No. It is a separate diaspora status and may relate to a different grant route. It does not prove Slovak or Czechoslovak citizenship.
Could later foreign citizenship affect Slovak status?
Yes. Slovak loss and reporting rules contain event-specific exceptions. Do not assume every future acquisition is harmless. See the former-citizen and dual-nationality guide.
Where is an application lodged?
The Act provides for personal lodging at a district office seated in a regional capital or at a Slovak mission or consular post. Obtain written current jurisdiction and procedure instructions. No universal filing sequence is published here.
What if an old filing used former Section 7(2)(j)?
Preserve the full file and obtain manual classification. Do not assume the 2026 restructuring automatically changes a pending case's requirements.
What if the authority requests evidence or stops or refuses the case?
Preserve the complete notice and delivery proof and seek prompt case-specific advice. The available remedy and timing come from the served decision and current procedure, not a website deadline calculator.
Who makes the decision?
The Ministry decides grants, while competent Slovak authorities determine or document status and give filing instructions. A private screening cannot decide either.
