Slovak residence permits, Section 8a(6), and where to file
Understand the unresolved tension between the Section 7(8) residence amendment and Section 8a(6), plus the authorities that receive applications.
The residence answer is not a simple yes or no
The law effective 15 July 2026 appears to remove a residence permit as an entry condition for the Section 7(8) descendant grant. Act No. 128/2026 moved the route out of the former authorized-residence chapeau, Section 7(8) waives Section 7(1)(a), and Section 8(3)(e) now requests residence evidence where residence must be proved.
A separate unchanged provision, Section 8a(6), says in Slovak that the Ministry stops proceedings if the applicant's residence permit ceases. A working translation is: “The Ministry shall stop the proceeding if the applicant's permitted residence in the territory of the Slovak Republic has ceased.” The Slovak text controls.
Some consular pages also continue to describe the former residence-first process. No located central implementation guidance reconciles those materials.
Safe practical rule
Do not publish or rely on “residence is irrelevant,” “a permit is definitely required,” or “apply directly without a permit.” Instead:
- confirm the current Section 7(8) procedure in writing with the Ministry or receiving authority before filing.
- if a Slovak permit is current, expiring, under renewal, or may cease, obtain case-specific advice immediately. And
- preserve any prior or pending former Section 7(2)(j) file for transition review.
This is the best reading of the dated statutory text, not a guarantee about administrative implementation.
Where is an application lodged?
Section 8 provides for personal lodging at a district office seated in a regional capital or at a Slovak diplomatic mission or consular post. Section 16 addresses domestic competence, including Bratislava for a person who has never resided in Slovakia.
That does not create one universal sequence. Confirm jurisdiction, appointment, personal attendance, originals, accepted questionnaire, authentication, translation, payment, forwarding, and instrument-collection instructions with the selected authority in writing.
