Lithuanian citizenship questions

Start with the route, then verify the dates and official records.

Is Lithuanian citizenship by descent automatic?
There is no single automatic ancestry rule. Article 14 can give citizenship at birth through a citizen parent. Article 9 reinstatement and Article 10 are applications with different tests.
What are the three main routes?
They are citizenship from birth through a citizen parent, Article 9 reinstatement through a pre-15-June-1940 citizen, and a discretionary Article 10 grant for a never-previously-Lithuanian person of Lithuanian origin. The current Citizenship Law controls.
Is Lithuanian birth, ethnicity, or a surname enough?
No. Those facts can guide research, but they do not alone prove legal citizenship. See the documents guide.
Is there a generation limit?
Article 9 reaches the historical citizen's child, grandchild, or great-grandchild. Article 10 reaches a Lithuanian-origin parent or grandparent. Article 14 has no fixed cap, but citizen status must pass at each birth.
What if my parent was Lithuanian when I was born?
Citizenship may have arisen at birth, including for a birth abroad. Prove legal parentage and the parent's citizenship on the birth date under the law then in force. See the Article 14 guide.
What does held citizenship before 15 June 1940 mean?
It means legal citizenship, not merely birth or residence in territory now within Lithuania. Historic acquisition and any legally effective loss must be checked under the relevant law.
Does a pre-1940 birth certificate prove citizenship?
Only if the document expressly states citizenship or has that legal effect. A place of birth by itself does not prove status. Article 38 identifies direct and secondary proof.
What if the archive finds no citizenship record?
A certified negative response identifies an evidence gap. It does not prove that the person was not a citizen. Other Article 38 evidence may need cumulative review.
Can I keep my current citizenship?
Possibly, but Article 9 ancestry does not decide Article 7. The applicable exception and the law of the other country must be checked separately. See the dual-citizenship guide.
What counts as exile or qualifying departure?
The current law defines these categories. Evidence may need to establish why, when, and from where the person left, the destination, permanent residence, and later return.
Why does residence on 11 March 1990 matter?
The departure exception asks whether permanent residence on that date was outside Lithuania. A family return can therefore change the analysis.
Does a later foreign naturalization prove departure?
No. It may help establish dates or residence, but does not by itself prove the required departure, permanence, destination, or exile.
What about departure after 15 June 1940 to former USSR territory?
The common permanent-departure exception excludes that defined situation. Exact geography, dates, residence, and possible exile facts require manual review under Article 7.
Is Article 10 restoration?
No. It is a discretionary presidential grant for a qualifying person of Lithuanian descent who never held Lithuanian citizenship. It is not proof of existing or restored status.
Can a great-grandparent support Article 10?
No. The statutory definition uses a parent or grandparent who is or was Lithuanian, plus the applicant's written self-identification. A great-grandparent may be relevant to Article 9 only if that person was a qualifying citizen.
Must I give up another citizenship for Article 10?
Ordinarily the other-nationality disposition rules apply. Any Article 7 exception must be established separately. Lithuanian ethnic origin does not itself create an exception.
How long does Article 10 take?
The published three-month stage is the Migration Department's preparation and referral to the Citizenship Affairs Commission, paused while requested corrections or evidence are outstanding. It is not an end-to-end completion estimate. See the Article 10 guide.
What happens if Lithuanian citizens adopt a child?
Current Article 17 says a child adopted by Lithuanian citizen or citizens acquires Lithuanian citizenship from the adoption date. Recognition of a foreign judgment and other facts still require review.
Does a Lithuanian child lose citizenship after foreign adoption?
Current Article 17 says the child remains Lithuanian. Article 7 addresses defined cases where adoption before age 18 also produces another citizenship. See the children guide.
Does a parent's later reinstatement automatically cover a child?
No. Article 27 has separate conditions for a child when a parent later acquires or regains citizenship. It does not backdate the parent's status to the child's birth.
When is a 14-to-17-year-old's consent relevant?
The consent rule applies in the Article 27 parent-citizenship-change route. It should not be imported as a separate citizenship-consent rule into Article 17 adoption.
Which archive proves citizenship and which proves civil status?
Request Lithuanian citizenship searches from LCVA. LVIA holds many historical civil and church records. Order the record that proves the required legal fact.
What do I submit in MIGRIS and when are originals shown?
Use the current generated service and upload the requested scans, apostilles or legalizations, and translations. Originals are normally presented after preliminary review under the selected office or mission's instructions. See the MIGRIS guide.
What are current fees and published periods?
The validated central figures are €120 for reinstatement and simplified grant and €50 for either certificate. Reinstatement applications accepted from 11 October 2024 have a published period up to 12 months, while relevant child procedures have 11 months. Recheck the live fee page. These periods do not state a final Article 10 completion time.
What happens after a refusal or missing-evidence request?
Preserve the complete notice, service date, requested materials, and filing record. Response and court deadlines require current legal review. A court is not a shortcut around the agency evidence stage.
